If an ICE Agent Comes to Your House

  • Do not open the door

  • Ask to see a judicial warrant through the window or ask for it to be slipped under the door

  • If they do not have a judicial warrant signed by a judge, ask them to leave

  • If the agent(s) enter(s) without a valid judicial warrant, ask for the agent(s) name(s) and badge(s)

If an ICE Agent Comes to Your Workplace

  • Do not run from an agent or resist arrest

  • Resisting arrest or stopping an ICE agent from arresting someone can lead to criminal charges against you

  • If the agent gives you a document to sign, you have the right to refuse to sign it and ask to talk to a lawyer about the document


If You are Arrested

  • You have the right to remain silent – ICE can use anything you say against you in your immigration case

  • You have the right to speak with a lawyer

  • You have the right to call the consulate of your birth country – the consulate may assist you in finding a lawyer

If You are Mistreated

  • You have the right to file a complaint

  • Take down important information: number of agents, names, badge numbers, locations, date, time, and other important details

Key Points

  • You don’t have to reveal your immigration status, including to law enforcement and security officers

  • Do not show false documents and do not lie to an immigration agent

  • Do not carry false identification

  • Do not carry papers from another country, such as a foreign passport or consular ID

  • Don’t say where you were born or how you entered the United States

Si un Agente de ICE Llega a su Casa

  • No abra la puerta

  • Pida ver la orden judicial por la ventana o por debajo de la puerta

  • Si no tiene una orden judicial firmada por un juez, pídale que se vaya

  • Si el agente entra sin orden judicial, pídale al agente su nombre y número de placa (si hay más agentes presentes, también pídales sus nombres y números de placa)

Si un Agente de ICE Llega a su Trabajo

  • No corra o resista ser arrestado por el agente
  • No se resista ser arrestado o trate de impedir que un agente de ICE arreste a otro individuo porque puede resultar en cargos criminales contra usted
  • Si el agente le da un documento para firmar, usted tiene el derecho de negarse a firmar el documento y poder hablar con un abogado sobre el documento

Si Usted es Arrestado

  • Usted tiene el derecho de permanecer en silencio – ICE puede usar lo que usted diga en su contra

  • Usted tiene el derecho de hablar con un abogado

  • Usted tiene el derecho de hablar con el consulado de su país de origen – El consulado puede ayudarle encontrar un abogado

Si un Agente lo Maltrata

  • Usted tiene el derecho de presentar una queja

  • Asegúrese de anotar información importante como los nombres de los agentes, los números de placa y el lugar, fecha y hora y cualquier otros detalles importantes

Puntos Importantes

  • Usted no tiene que revelar su estatus migratorio, incluyendo a los agentes de ley
