Rep. Jimmy Gomez and 250+ House Democrats File Amicus Brief Against Trump’s Illegal Attempt to Fire Independent Labor Board Members

Trump Fires Labor Watchdogs to Shield Elon Musk and Silence the Referees Protecting Workers’ Rights

WASHINGTON, DC – Representative Jimmy Gomez (CA-34) — member of House Democrats’ Litigation and Rapid Response Task Force — and more than 250 House Democrats filed an amicus brief opposing Donald Trump’s unlawful attempt to fire members of the National Labor Relations Board (NLRB) and the Merit Systems Protection Board (MSPB). These independent agencies play a vital role in protecting workers’ rights and maintaining a nonpartisan, merit-based federal workforce.

The officials targeted were duly appointed and confirmed by Congress. Trump’s illegal effort to remove them undermines the integrity of these institutions and threatens their ability to defend workplace democracy and fair treatment for American workers.

“Trump fired two NLRB officials, including one whose term runs until 2028, just after they opened cases against Elon Musk’s companies,” said Rep. Gomez. “This is a direct attack on workers and unions. Trump and Musk want to silence the referees so they can rewrite the rules for billionaires — and we’re not going to let that happen.”

The filing was led by Litigation Task Force Co-Chair Assistant Leader Joe Neguse and Ranking Members Jamie Raskin, Bobby Scott, and Gerry Connolly, along with House Democratic Leader Hakeem Jeffries and Senate Democratic Leader Chuck Schumer. It comes as Trump and Musk attempt to purge independent agencies and replace career civil servants with political loyalists.
